The Swedish model for the acquisition of defence material has since the mid-2000s undergone a paradigm shift.
Historically, the Swedish government, through Swedish Defence Material Administration (FMV), has financed the development of customized defence material by directed procurement. In the early 2000s, FMV began a shift towards procuring ready-made material, so called Commercial off-the-shelf, by competitive tendering, in accordance with the Government Procurement Act.
Today, competitive tendering in accordance with the Defense and Security Procurement Act is predominantly preferred, while directed procurement is more unusual.
We have over 20 years experience in the defense and security industry.
The new procurement procedure has brought more procurement decisions to judicial inquiry, which ultimately results in the user, i.e armed forces, receiving their material too late.
The losing tenderer usually turns to a lawyer for help to mount a possible overturn. It is, however, unusual for a tenderer to turn to a lawyer pro-actively in order to avoid a negative outcome. We would like to change that.
